A guy convicted of breaking a female’s hands by having a crowbar has filed an application that is mistrial alleging brand brand new medical evidence shows the victim’s accidents had been brought on by dropping, maybe not being struck.
Jared Eliasson is waiting for sentencing after being convicted earlier this season of a 2017 assault described in court as a morning hours road-rage event.
However in an application filed in Edmonton Court of Queen’s Bench on Wednesday, Eliasson contends the judge in the event should purchase a mistrial, or vacate the convictions and reopen the test to know brand new proof.
“The newly disclosed X-rays together with viewpoint page from Dr. McLeod call into question the once uncontroversial suggestion that the accidents had been due to being struck with a steel club,” the defence alleges into the application.Continue reading
